These Terms and Conditions set out the basis on which Rubbish Removal Hackney provides rubbish removal, waste collection and related services to customers. By placing a booking with us, you agree to be bound by these Terms and Conditions. Please read them carefully before arranging any collection or clearance.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means any individual, business, organisation or other entity that requests or receives services from Rubbish Removal Hackney.
Services means the rubbish removal, waste collection, clearance, loading, transportation and disposal services provided by Rubbish Removal Hackney, including any ancillary services agreed in writing.
Waste means any rubbish, junk, household waste, commercial waste, bulky items or materials that the Customer requests us to collect, remove or dispose of, subject to applicable regulations.
Contract means the agreement between Rubbish Removal Hackney and the Customer for the provision of Services, incorporating these Terms and Conditions and any written quotation or confirmation issued by us.
Rubbish Removal Hackney provides scheduled and one-off rubbish removal and waste collection services for domestic and commercial customers in its service area. The precise scope of the Services for each booking will be as described in the quotation or booking confirmation supplied to the Customer.
Unless expressly agreed in writing, our Services do not include specialist hazardous waste removal, demolition works, structural alteration, plumbing, electrical works or cleaning beyond basic sweep-up after a clearance.
We reserve the right to decline collection of any items that cannot be safely lifted, carried or transported by our team or which are prohibited under applicable waste regulations.
3.1 Booking requests can be made by telephone, email or other communication methods accepted by Rubbish Removal Hackney from time to time. All bookings are subject to availability and confirmation by us.
3.2 To provide an accurate quotation, we may request information including but not limited to: type and approximate quantity of waste, location and access details, floor level, parking arrangements, and any time restrictions. We may request photographs or a site visit in order to confirm the scope of work.
3.3 Any quotation given based on the Customer's description, information or images is an estimate only. If, upon arrival, the actual volume, weight, nature or location of the waste differs from that described, we may revise the price accordingly or, if we are unable to proceed, charge a reasonable call-out fee.
3.4 A booking is only confirmed when Rubbish Removal Hackney has issued an explicit confirmation, which may be by email, text message or verbal confirmation followed by a written record.
3.5 The Customer is responsible for ensuring that all access arrangements are in place for the agreed collection time, including keys, entry codes, concierge permissions, parking suspensions or permits, and that any required third-party consents have been obtained.
4.1 The Customer must provide accurate and complete information about the nature, quantity and location of the waste to be collected. This includes disclosing any items that may be hazardous, heavy, awkward to handle or restricted by law.
4.2 The Customer warrants that all waste presented for collection is owned by them, or that they have full authority to dispose of it. The Customer agrees to indemnify us against any claim from a third party alleging wrongful removal or disposal of items.
4.3 The Customer must ensure that the waste is reasonably accessible at the agreed time. If waste is blocked by other items, vehicles, locked doors or other obstacles, we may charge waiting time, a no-access fee or reschedule the booking at additional cost.
4.4 The Customer shall not include any prohibited or hazardous materials in the waste unless expressly agreed in advance and in compliance with all relevant legislation. Prohibited items may include, without limitation, asbestos, certain chemicals, clinical and medical waste, gas bottles, explosives, and liquids not permitted for transport.
5.1 Prices for our rubbish removal and waste collection services are typically based on volume, weight, labour time, type of waste, access conditions and disposal costs. We will explain the charging structure at the time of booking.
5.2 All quotations are given in good faith based on the information provided. Quotations are not binding if the information supplied by the Customer is incomplete or inaccurate, or if conditions change between the time of quotation and the service date.
5.3 Unless otherwise stated, all prices exclude VAT and any local charges such as parking fees, congestion charges or tolls. Such additional costs may be added to the final invoice where applicable.
5.4 Rubbish Removal Hackney reserves the right to amend its prices at any time. Any price change will not affect a confirmed booking unless the scope or conditions of the job change.
6.1 Payment terms will be specified at the time of booking. For most residential customers, payment is due on completion of the collection, before our team leaves the site, unless agreed otherwise in writing.
6.2 We may require a deposit or full pre-payment for certain bookings, including but not limited to large clearances, out-of-hours services, or commercial contracts. Any required deposit will be discussed at the time of booking.
6.3 Payment can be made by cash, card or other methods accepted by Rubbish Removal Hackney. We do not accept payment by cheque unless expressly agreed in advance.
6.4 Where credit terms are agreed in writing for commercial Customers, payment will be due within the period stated on the invoice. If no period is stated, payment shall be due within 14 days of the invoice date.
6.5 If the Customer fails to make any payment on the due date, Rubbish Removal Hackney reserves the right to charge interest on the overdue amount at the statutory rate and to recover any reasonable costs incurred in the collection of the debt.
7.1 The Customer may cancel or amend a booking by contacting us during our normal office hours. Any cancellation or amendment is effective only when acknowledged by us.
7.2 If the Customer cancels a booking more than 24 hours before the scheduled collection time, no cancellation fee will normally be charged, unless a non-refundable deposit has been agreed for that booking.
7.3 If the Customer cancels less than 24 hours before the scheduled collection time, or fails to provide access when our team arrives, Rubbish Removal Hackney may charge a cancellation or call-out fee to cover wasted time and costs.
7.4 If the Customer wishes to change the date, time or scope of the Services, we will use reasonable efforts to accommodate the request but cannot guarantee availability. Any change may result in an adjustment to the quoted price.
7.5 Rubbish Removal Hackney reserves the right to cancel or postpone a booking due to circumstances beyond our reasonable control, including adverse weather, traffic incidents, vehicle breakdown, staff illness or safety concerns. Where possible, we will offer an alternative appointment at the earliest available time.
8.1 We will use reasonable efforts to arrive at the agreed time, but any arrival time given is an estimate and not guaranteed. We shall not be liable for any loss or expense incurred by the Customer due to delay, provided we act with reasonable care and diligence.
8.2 The Customer must ensure safe and adequate access for our vehicles and staff to the collection point. Charges may apply for additional labour or time required due to access difficulties, such as carrying items over long distances, multiple flights of stairs or lack of suitable parking.
8.3 We reserve the right to refuse to carry out all or part of the Services if our staff consider that doing so would pose a risk to health and safety, cause damage to property, or breach any applicable regulations or restrictions.
8.4 Rubbish Removal Hackney will take reasonable care when loading and removing waste. However, the Customer is responsible for protecting carpets, floors, walls and other fixtures, for example by covering walkways or moving fragile items out of the way before our arrival.
9.1 Rubbish Removal Hackney operates in accordance with applicable UK waste management laws and regulations. We are committed to responsible waste disposal and recycling wherever practicable.
9.2 Once waste has been loaded onto our vehicle and removed from the site, ownership of that waste transfers to Rubbish Removal Hackney, subject to compliance with all applicable regulations.
9.3 Certain types of waste are subject to specific legal requirements, such as electrical items, fridges and freezers, tyres, batteries and other regulated materials. We may apply additional charges for handling and disposing of such items in compliance with the law.
9.4 We will not accept hazardous or prohibited waste unless explicitly agreed in advance and handled under appropriate licences and controls. If such items are discovered amongst the waste without prior agreement, we may refuse to remove them, or we may charge additional costs or require the Customer to remove them before we proceed.
9.5 The Customer agrees that all waste handed over to us complies with relevant legislation and does not contravene any duty of care obligations. The Customer remains responsible for any breach of such obligations arising from misdescription, concealment of hazardous items or other improper actions.
10.1 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter which cannot be excluded or limited by law.
10.2 Subject to the above, Rubbish Removal Hackney shall not be liable for any indirect, consequential or economic loss, including loss of profits, loss of business, or loss of opportunity arising out of or in connection with the Services.
10.3 Our total liability to the Customer in respect of any claim arising out of the Contract, whether in contract, tort or otherwise, shall be limited to the total amount paid or payable by the Customer for the specific Services giving rise to the claim.
10.4 The Customer is responsible for identifying and removing any items they wish to keep before our team commences work. We accept no liability for the accidental removal or disposal of items that were not clearly separated or identified as not to be taken.
10.5 We shall not be liable for damage to driveways, paths, surfaces or underground services caused by the weight or movement of our vehicles, where the Customer has requested or permitted us to drive or park on or near such areas.
10.6 The Customer shall notify us in writing of any claim for loss or damage as soon as reasonably practicable and in any event within seven days of the completion of the Services, providing reasonable details and evidence.
11.1 Rubbish Removal Hackney aims to provide a professional service for all rubbish removal and waste collection jobs. If you are dissatisfied with any aspect of our Services, please contact us as soon as possible so that we can investigate and, where appropriate, put things right.
11.2 We will acknowledge complaints received and aim to respond within a reasonable timeframe. We may request further information or evidence to help us understand and resolve the issue.
11.3 Where a dispute arises that cannot be resolved through our internal complaints process, the parties will consider in good faith whether it can be settled through negotiation or, if appropriate, mediation before resorting to court proceedings.
12.1 In the course of providing Services, Rubbish Removal Hackney may collect and process personal information about Customers, such as contact details and service history.
12.2 We will use such information only for legitimate business purposes, including managing bookings, providing services, handling payments, and complying with legal obligations.
12.3 We will take reasonable steps to keep personal information secure and will not share it with third parties except where necessary to deliver the Services, process payments, or meet legal or regulatory requirements.
13.1 Rubbish Removal Hackney may update or amend these Terms and Conditions from time to time. The current version will apply to all new bookings and will be made available on request.
13.2 Any change to the Terms and Conditions will not affect a Contract that has already been formed, unless the Customer agrees to the change in writing.
14.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be treated as deleted, but the remaining provisions shall continue in full force and effect.
15.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of England and Wales.
15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
By making a booking with Rubbish Removal Hackney, you confirm that you have read, understood and agree to these Terms and Conditions governing our rubbish removal and waste collection services.
